Throughout these
terms the following words shall have the following meanings;
"Company" - NMP Seminars Ltd.
"Seminar" - The live Seminar for which tickets have been
purchased by the Delegate(s).
"Delegate" - Person or persons attending the Seminar.
BOOKINGS
The number of Delegates at each seminar is limited. Registration
is on a first come, first serve basis, until the Seminar
reaches
its capacity.
The Company shall aim to confirm Delegate place(s) at the
Seminar within 3 working days of receiving the completed booking
form together with full payment.
Bookings can be made by credit/debit card online at the secure
Seminar website. Alternatively a PDF booking form can be downloaded
on the website and faxed or posted to the Company. Postal
submissions may be made by cheque instead of credit/debit
card. Delegates may also book over the telephone by calling
the Company during office hours.
For security & fraud prevention, tickets and correspondence
can only by mailed to the cardholder's billing address. Once
the booking has been accepted a confirmation letter, including
all pertinent information relative to the seminar, including
dates, times, and location shall be sent to the cardholder/lead
delegate.
SEMINAR FEES
Seminar fees include the full day presentation, morning
coffee and afternoon tea, plus a delegate pack
containing pre-printed notes from the Seminar schedule.
SEMINAR TIMES
Registration commences at 8AM. Seminars run from 9AM and conclude
at 5PM. There is a one-hour lunch break (with the provision
for networking), and a 15-minute morning and afternoon break.
Notifications of any changes shall be provided in good time.
Every effort to admit latecomers will be made at a suitable
break in the event, but admission cannot always be guaranteed.
SEMINAR ATTIRE
Smart casual attire is appropriate for the Seminar.
TRAVEL ARRANGEMENTS
Delegates are responsible for their own travel and lodging
arrangements.
PAYMENT
To secure place(s) at the Seminar, payment in full is due
at the time of booking. For corporate bookings the Company
is able to issue pro-forma invoices but places will not be
confirmed until the invoice has been settled in full.
REFUNDS, EXCHANGES & FAILURE TO ATTEND
The Company regrets that Seminar tickets cannot be exchanged
or refunded after purchase unless the event is cancelled by
the Company (see below).
The Company shall not be responsible for any tickets that
are lost or stolen.
If a delegate fails to attend the Seminar for which they have
purchased a ticket, for whatever reason whatsoever, the full
Seminar fee remains payable.
CANCELLATIONS & POSTPONEMENTS
The Company reserves the right to change dates and/or venues,
it also reserves the right to alter the Seminar content,
location
or cancel any seminar at any time without liability.
The Company shall not be held responsible for any extra costs
incurred as a result of a cancelled Seminar, and therefore
it does not recommend any Delegate make non-refundable airplane,
hotel or car rental arrangements.
In the highly unlikely event that the Company needs to cancel
or postpone a Seminar, places will be offered to Delegates
at any rescheduled event (subject to availability) up to the
face value of the tickets or, if the Delegate is unable to
attend the rescheduled Seminar or the Seminar is not rescheduled,
a full refund shall be made.
Full refunds for tickets purchased prior to the date of the
original event will be given up to the face value of the tickets
purchased. This does not affect your statutory rights.
TRANSFERS & RESALE
Delegates represent and warrant that the Seminar ticket is
purchased for personal use only, and in particular, that the
ticket may not be resold or offered for resale by anyone whether
at a premium or otherwise and may not be used for advertising,
promotion (including contests and sweepstakes) or for any
other trade purposes.
Resale or attempted resale at a price higher than face value
of the ticket is grounds for seizure or cancellation without
refund or other compensation, this includes, for the avoidance
of doubt, any publication via the internet or any other means
with the intent to resell for commercial gain.
COPYRIGHT, OWNERSHIP AND QUALITY OF INFORMATION
All Seminar documents contain information which is protected
by copyright. The Company shall retain all rights including
to the reproduction of Seminar documents or parts thereof.
No part of the Seminar documents may be reproduced in any
form whatsoever or in particular processed, copied, disseminated
or used for public presentation using electronic systems without
the prior written consent of the Company. Software which may
be provided during the execution of the seminar may not be
removed or copied either in whole or in part.
Title to all intellectual property rights existing in any
documentation, data, know-how, methods and concepts, used
or developed by the company in facilitating the Seminar, shall
belong to and remain vested in the Company at all times.
PHOTOGRAPHY & FILMING
Delegates consent to being filmed as members of the Seminar
audience. Additionally, they may be asked to take part in
optional on-screen feedback for the purposes of future marketing
of the Seminar(s).
The unauthorized use of photographic and recording equipment
is prohibited. Tapes or films may be destroyed. Laser pens,
mobile phones, dogs (except guide dogs) and patron's own food
and drink may also be prohibited (please check with the venue).
UNFORSEEN EVENTS
Seminar places are sold subject to the Company's right to
alter or vary the programme due to events or circumstances
beyond its reasonable control without being obliged to refund
monies or exchange tickets.
The Company shall be entitled to delay or reduce the level
and/or scope of service(s) if it is prevented from or hindered
or delayed in obtaining or delivering the services (including
session materials) as a result of any circumstances beyond
our reasonable control.
GUARANTEES & LIABILITY
The Company expressly disclaims all warranties of any kind,
whether express or implied, regarding the Delegate's success
following attendance at the Seminar. Any decisions made by
the Delegate, having received information or advice at the
Seminar, are their own and they remain wholly responsible
for any decisions and actions they take.
DATA PROTECTION
When a booking is made with the Company, all personal data
supplied will be used in accordance with data protection laws
and the Company's own privacy policy.
HEADINGS FOR CONVENIENCE ONLY
The section titles in these Terms & Conditions are for
convenience only and have no legal or contractual effect.
NON-WAIVER & GENERAL TERMS
These Terms and Conditions constitute the entire agreement
between the Company and the Delegate and it supersedes any
previous agreement between these parties relating to any services
provided by the Company, unless otherwise agreed in writing.
Both parties agree that by entering into this agreement, neither
has relied on, and is not able to have any remedy, for any
statement, promise, representation or understanding (whether
it is made negligently or innocently) or any person other
than what is expressly promised in this agreement. The only
remedy available for breach of the promises in this agreement
is for breach of contract. Nothing in this paragraph attempts
to limit of exclude any liability for fraud.
The failure of the Company to exercise or enforce any right
or provision of these Terms & Conditions shall not constitute
a waiver of such right or provision. If any provision of these
Terms & Conditions is found by a court of competent jurisdiction
to be invalid, the parties nevertheless agree that the court
should endeavor to give effect to the parties' intentions
as reflected in the provision, and the other provisions of
the Terms & Conditions remain in full force and effect.
Delegates agree that regardless of any statute or law to the
contrary, any claim or cause of action arising out of or related
to use of the Service or the Terms & Conditions must be
filed within one (1) year after such claim or cause of action
arose or be forever barred.
All parties agree that each provision of this agreement is
severable and distinct from any other. If any part of this
agreement is found to be illegal, invalid or unenforceable
in whole or in part, all parties agree that the legality,
validity and enforceability of the remainder of the agreement
is not affected.
No terms of this agreement are intended of the benefit of
any third party, except where expressly stated in this agreement,
and all parties agree that it is not intended that and term
of this agreement should be enforceable by a third party under
the Contracts (Rights of Third Parties) Act 1999. If you choose
to make an order, these terms and conditions only apply to
that order and not to any future orders.
Bookings are subject to the terms and conditions contained
herein.
All of these terms and conditions are governed by English
Law.
